Planning and Zoning Commission Meeting Minutes for December 16, 2015

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on
Wednesday, December 16, 2015 at Tioga City Hall, 600 Main Street, Tioga, Texas.

Call to Order:  The public meeting was called to order at 7:01 p.m.
Prayer: Given by Kristi Staples
Declaring a Quorum: A quorum was declared.  The committee members present were Arlene Joice, Janet Sloane, Patrick Coyle, and Kristi Staples.  Dale Cavin was not in attendance.
Approval of Minutes:  October and November minutes were read and approved.  Motion made by Janet Sloane seconded by Patrick Coyle.  All ayes.

Committee Discussion
This was a short meeting to discuss the upcoming city survey being conducted by the planning and zoning committee.
Patrick Coyle agreed to make a flyer that Kristi Staples agreed to make copies of and post around town.  Arlene and Janet agreed to advertise by email and social media.
The questions were finalized and the survey will be done through an online service.  There will also be paper copies available at city hall with a locked drop box for anonymity.
It was agreed that the survey would run through the middle of February.
Next Meeting:  Planning and Zoning Committee will meet Wednesday, January 27, 2016 at 7:00 p.m.
Adjourn:  Kristi Staples made a motion to adjourn at 7:46 p.m. Janet seconds, passes all ayes.

Meeting Held November 18, 2015
A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, November 18, 2015 at Tioga City Hall, 600 Main Street, Tioga, Texas.

Call to Order:  The public meeting was called to order at 7:00 pm
Prayer: Given by Janet Sloane
Declaring a Quorum:  A quorum was declared.  The committee members present were Arlene Joice, Janet Sloane, Dale Calvin, Patrick Coyle, and Kristi Staples.  Also present were Commissioner Phyllis James, Park Officer Chris True, and Carol Nichols with LRRETA, as well as many others in association with parks, horses and trails.

Approval of Minutes:  October minutes tabled until November meeting.

Roundtable Discussion
Com. James- We have to look at our assets, what do we have that others will want to use and utilize.
How do we build on the idea that horses and Lake Texoma are a part of Ray Roberts.
Chris True- Trails are the #1 facility requested by the public.
Lots of talk about what our part could be in starting a lake trail for hiking, horseback riding, and mountain biking.  Who owns the property, whose permission and backing do we need, and leasing of the land from whom.  Discussion about current use of lakefront and potential future use.  Discussion about maintenance of trails and parks and their daily usage.
Mr. True said that a municipality will want reassurance that a political entity will support us and take responsibility for safety.
Need some grant writers for funding, funds are available out there.
Members of other successful organizations gave helpful insight into the workings of a trail park.
As we are thinking about the future for funding and planning, we need to look at a multi-use facility and the issues associated with that.
Most likely best suited for a low density trail facility where there are not a lot of hard facilities like picknicking, rest rooms, and camping.
Grayson County does not currently have a master plan for thoroughfares in place.
Lots of excitement in the room, lots of potential for future growth.

Planning and Zoning Commission Meeting Minutes
Meeting Held October 28, 2015

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, October 28, 2015 at Tioga City Hall, 600 Main Street, Tioga, Texas.

Call to Order:  The Public meeting was called to order at 7:04 p.m.

Prayer:  Given by Janet Sloane

Declaring a Quorum:  A quorum was declared. The committee members present were Arlene Joice, Janet Sloane, Dale Cavin, Patrick Coyle, and Kristi Staples.  Also present were guests James Hilliard, Bennie McKnight, Britt Mayo, Angie Kendrick, and Gretchen Coyle.

Public Hearing:

Tonight’s meeting included a public hearing on a request for a zoning change from C-3 to a C-2 at 103 and 105 Ray Roberts Parkway by James Hilliard.

James Hilliard spoke first on what he felt were the benefits and advantages of the zoning change.  He informed the committee that the plans for the two lots was for future placement of a car lot that would have about 15 - 20 cars.  He said that this was not part of the downtown and that it faced the 377 Thoroughfare. He also brought pictures of old Tioga as a “historical” reference stating that the downtown area did once have gas and motor services through Woodall (oil and gas) many years ago.

Next to speak was Britt Mayo, a community member.  He stated that based on the reputation of Clark’s (also James Hilliard) that he did not see any issue with the zoning being changed.  He felt that Clark’s was a loyal supporter of the community and that they paid their taxes and kept things clean, so would probably do the same with whatever else they opened.

Next to speak was Bennie McKnight, he would actually be running and maintaining the car lot. He is a resident of Tioga at 600 Gene Autry.  He is from Tioga, this is his home. He was an automobile dealer in Dallas for 53 years and maintained a business there without problem. Mr. McKnight claims that within the first year there will be a business (in his dealership) that Tioga can be supportive of . He plans in the future to expand by purchasing the lot next to the lots requesting zoning change.

Dale Cavin asked if Mr. McKnight would be doing repairs at the lot?

Mr. McKnight said that there were plans to build or add on a place where repairs will be done inside a shop.  The plans were to be doing small repair work at a later date.

He assured the committee that the lot would be well maintained and would be landscaped well to add aesthetic appeal and that all repairs would be done inside the shop not out in the open.

Last to speak was community member Angie Kendrick. Her question was “Will this continue to be a storage facility?”  She said from all that she could see, there was no car lot there but instead a storage facility for machinery.  She said that this raised concern in her mind about an increase in theft and other related crime. She also was concerned about a decrease in property value. She did not have a problem with a car lot being there but was mostly concerned about it’s appearance from her home, which was in full view of the business, and about noise and movement.

Argument for zone change was that the property serves toward 377 not towards the Historic District.

Planning and Zoning Commission’s stance was that the zoning remain as it is. Our concern about letting the lot go to C-2 was for future use after this.  Also, we did not feel that a car lot added to the historic or traditional charm of our town at a potentially critical entry point into our downtown area.

Adjourn:  Public Hearing was closed at 7:38 p.m.

Discuss and Consider a request for zoning change:

Janet Sloane: not for change of zoning

Dale Cavin: Suggested a Special Use Permit to accommodate instead of changing zoning completely and leaving us the ability to revoke.

Patrick Coyle: Does not like the feel of a car lot being at the entry point of Tioga.  He would like to carry a feel of what Tioga is out to the public road. He feels that if what we envision as a look and theme for Tioga and the downtown area is not carried out to the road then the downtown area and the heart of the town will become isolated. We have 377 as a critical entry into Tioga, with a bridge separating us from Pilot Point, leaving us the ability to be different and make Tioga its own.  He feels that at this point it would be a mistake to give that away.

Kristi Staples: not for change of zoning

Donna Carney sent out a letter to the community, no one responded.

Dale Cavin made a motion that the Planning and Zoning Commission recommend to the City Council that we keep the lots at 103 and 105 Ray Roberts Pkwy C-3 zoning. Patrick Coyle seconded. Motion carried all ayes.

Our recommendation was on the basis that in order to preserve the integrity of the property , so that we maintain a historical presence all the way to the 377 thoroughfare, we must keep the C-3 zoning. Leaving the lot to be used as a focal point to the entrance of the downtown area.

Approval of Minutes:  Minutes from the September 30, 2015 meeting were reviewed and approved with corrections to be made.  Motion made by Janet Sloane to accept as amended and seconded by Dale Cavin. All ayes.

Discuss Citizen Survey:  The committee looked over the introduction to the survey being sent out to Tioga citizens using Survey Monkey.  We also went through each question to add and delete questions and answer choices trying to refine each one to eliminate as much confusion, overlapping of information, and bias as possible.

We worked and reworked the questions finally agreeing on 10.

The committee decided to advertise now that the survey will be available in January for the whole month to get resident information and survey responses.

Next meeting set for November 18, 2015 at 7:00 p.m. Moved up because of Thanksgiving Holidays.

Call to Order:  The public meeting was called to order at 7:01 p.m.

Declaring a Quorum:  A quorum was declared.  The committee members present were Arlene Joice, Janet Sloane, Dale Cavin, Kristi Staples and Patrick Coyle.  Patrick Coyle’s first meeting, new member. Guests, James Hilliard and Gretchen Coyle.

Approval of Minutes: Minutes from the June 2015 meeting reviewed and approved with corrections to be made.  Motion made by Janet Sloane and seconded by Kristi.  All ayes.  August 2015 meeting minutes were reviewed and approved.  Dale Cavin made the motion, Janet seconded. All ayes.

Discuss and Consider Request for Zoning Change

James Hilliard was present to discuss his request to change his property located at 103 and 105 Ray Roberts Parkway from C-3 to C-2.

James Hilliard presented his case to the Planning and Zoning Committee for a zoning change.  His cousin is wanting to put a car lot at the above mentioned address.  Donna from City Hall informed them that the property was improperly zoned for this type of business. James Hilliard informed the committee that he has already contacted community members, whose properties are zoned C-2 and who are near his property.  He claims that the neighboring community members are fine with the change.  He also said that there will be no junk cars on the lot, that they are looking to make it into a true car dealership.  They will not be a full service repair shop but will do detailing and minor repairs such as headlights and taillights. He claims the business will be good for the City of Tioga and will add value through its many benefits.

Patrick Coyle spoke out with concerns about rezoning 103 and 105 Ray Roberts Parkway, citing that changing the zoning to C-2 could compromise the integrity of the city square proper (downtown area).

No action was taken.  Next step is to set a public hearing.  This will be in conjunction with the regularly scheduled Planning and Zoning meeting on October 28, 2015 at 7:00 p.m.

Citizen Survey

A video presentation has been posted on All Things Tioga by Janet Sloane.  The video was posted to open discussion by Tioga community members on the topic of the Tioga 377 Corridor and to get an informal survey of the communities views and ideas of what they want our town to look and feel like.

It was decided that we would do a survey using Survey Monkey to try to get community input on what they would like to see as our town grows.

Patrick Coyle agreed to draft an introduction to the survey.  Arlene Joice agreed to collect and write the questions.  Any questions from the Planning and Zoning Committee to include in the survey should be sent to Arlene by October 17, 2015.  The questions and introduction should be unbiased and should not be leading.  Surveys that are to be written will be dropped in a sealed drop box.

Janet Sloane also had the opportunity to talk with some people about our continued discussion plan for our lake area, working towards trails, walking and/or horse, educational services, picnicking, kayaking, etc. She spoke with Carol Nichols with the Lake Ray Roberts Equestrian Trail Association and Chris True with the Texas Parks and Wildlife.  Chris True said that he would be willing to come and speak to us at one of our regularly scheduled meetings.  Janet will ask him if he is available to speak with us at the November meeting, to be held on November 18th.

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, August 26, 2015 at Tioga City  Hall, 600 Main Street, Tioga, Texas.

Call to Order:  The public meeting was called to order at 7:03 p.m.

Prayer:  Given by Dale Cavin

Declaring a Quorum:  A quorum was declared.  The committee members present were Arlene Joice, Janet Sloane, Dale Cavin, Kristi Staples and Paula Byler.  Guest, Mayor Craig Jesek.

Approval of Minutes: Minutes from the June 2015 meeting were tabled until the September meeting.

Updates on Pending Projects

Mayor Jesek presented the committee with a brief overview of things going on around the city.  Spirit of the West Wellness Center is to open in March of 2016. City is talking with them about running a 6 inch water line for sprinklers.  Also, the city is talking with the RR Commission trying to work out a no blow through the city of Tioga.  Lots of homes being built in the city currently. John Teltschik came into the city, trying to decide what he is going to do with his property. 18 houses have been taken down. Two new businesses, the Farm Bureau at Gressett’s and the clothing boutique next to Salon PhD.  Park built up and refurbished.

Discussion about the future of the toll road.  Discussion about potential growth in Downtown area.  Discussion about current and possible future ideas for a Disaster Plan.  Discussion about possibilities of utilizing the lake as a draw.

Have to instill support of local business in people in the community.

Decided it was a good idea to put survey out on social media to get a feel for what the community is thinking and wanting.

Paula Byler resigned from the P&Z to put her efforts toward the Museum Board and trying to restart the Chamber of Commerce.  Asked the P&Z to consider replacements for her position.

Meeting Held June 24, 2015
A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, June 24, 2015 at Tioga City  Hall, 600 Main Street, Tioga, Texas.

Call to Order:  The public meeting was called to order at 7:11 p.m.

Prayer:  Given by Janet Sloane

Declaring a Quorum:  A quorum was declared.  The committee members present were Arlene Joice, Janet Sloane and Kristi Staples. Dale Cavin called in informing the committee he would not be in attendance Paula Byler did not.  Guests Robert Lawton and Sarah Boyd (local realtor).

Approval of Minutes: Minutes from the March 25, 2015 meeting were read and approved.  Motion made by Janet, seconded by Kristi, motion carried all ayes.

Address Two Pieces of Property on Hwy 377.  Property owned by John Teltschik, in the ETJ north on Hwy 377. He has started the process of annexing the property into the City of Tioga. Owner would like suggestions from P&Z on appropriate zoning designation.  The property is two pieces that joined total 10 acres.  They are tied or connected together.  The property currently has trees, a house, and a pond that might not be staying.  Robert Lawton is present to represent John Teltschik, who plans to develop the property.

The P&Z committee recommends a C2 Zoning designation, citing that this will allow him the most flexibility for future development. Motion make by Kristi, seconded by Janet, motion carried all ayes.

Item #6 on the agenda, update on projects in progress and future projects proposed for the city from the mayor, tabled.  Mayor Jesek was unable to attend the meeting.

Discussion around looking at the school zone district and busing routes.

Discussion about past infrastructure and how to work towards city growth and incentives for businesses.

Presentation needs to be composed to present a Historic District Plan to the City Council of Tioga.

Next meeting July 29, 2015.

Meeting Held May 20, 2015
A regular meeting of the Planning and Zoning Commission of the City of Tioga, TX was held on Wednesday, May 20, 2015 at Tioga City Hall, 600 Main Street Tioga, TX.

Call to Order: The public meeting was called to order at 7:00 p.m.
Prayer: Given by Janet Sloane
Declaration of a Quorum: A quorum was declared.  Committee members present were Arlene Joice, Janet Sloane, Kristi Staples, and Dale Cavin.

Approve Minutes: Minutes for March meeting were not prepared for meeting, so approval was tabled until the June meeting. No April meeting was held.

Continue work on 377 Thoroughfare Plan and Historic District Plan:
Bring information on Historic Districts to the June meeting. Do areas zoned as Historic Districts have to be contiguous?

Survey Monkey is a free survey site, perhaps members could look over to help determine questions and surveys we can use as a committee.

Invite Mayor Craig Jesek to June meeting.

A regular meeting of the Planning and Zoning Commission of the City of Tioga, TX was held on Wednesday, March 25, 2015 at Tioga City Hall, 600 Main Street Tioga, TX.

Call to Order: The public meeting was called to order at 7:03 p.m.

Prayer: Given by Kristi Staples

Declaration of a Quorum: A quorum was declared.  Committee members present were Arlene Joice, Janet Sloane and Kristi Staples.

Approve Minutes: Janet made a motion to approve minutes from 12/16/2014 meeting. Kristi second. All ayes. Minutes approved. Janet made a motion to approve minutes from 1/28/2015 meeting. Kristi second. All ayes. Minutes approved.

Continue work on 377 Thoroughfare Plan and Historic District Plan:

Janet asks about putting presentation out on social media for input from the community.

Arlene reiterated that part of our job is to relay community ideas and concerns to the city.

We agree that social media could be a valuable and useful tool for informing the community and getting feedback to present to the City Council if necessary.

For future meetings we would like a copy of the policies and protocol for public hearings. Arlene will send out her procedures that she had written out.

We agree to come to next meeting with questions to ask the community to assess community needs, wants, and ideas for future city planning.

January 28 Public Hearing and Regular Meeting

Meeting Held January 28, 2015

A regular meeting of the Planning and Zoning Commission of the City of Tioga, TX was
held on Wednesday, January 28, 2015 at 7:00 p.m. at Tioga City Hall, 600 Main Street
Tioga, TX.
Call to Order: The public meeting was called to order at 7:02 p.m.
Prayer: Given by Janet Sloane
Declaration of a Quorum: A quorum was declared. Committee members present were
Arlene Joice, Janet Sloane, Dale Cavin, and Paula Byler. Kristi Staples was present but
late, arrived before close of Public Hearing and open of Regular Meeting.
Public Hearing: Receive public comment on a request by David Umsted for a specific
use permit to allow a portable building to be used as an office for portable building sales
at 709 N. Ray Roberts Parkway.
David Umsted spoke about building.
Arlene read rules of order and conduct for Public Hearing.
Those in attendance for Public Hearing Arlene Joice, Paula Byler, Janet Sloane, Dale
Cavin, Kristi Staples, Kelly Lintner, Kyle Swanson, Robin Skelton, Leonard Skelton,
Wilma Gorham, Paul Rodimer, Sherry May, Garry Burchett, David Umsted, and Terry
Hilliard
Five people spoke at the hearing. Two spoke for David Umsted’s use of a temporary
(portable) building, one was neutral on the topic and two expressed some concerns.
Adjourn Public Hearing: Public Hearing adjourned at 7:14 p.m.
Open Regular Meeting: Regular meeting opened at 7:14 p.m.
All committee members present.
Paula Byler clarified that a Specific Use Permit is given to a specific person for a
specific use. It is not transferable, addressing Wilma Gorhom’s concerns.
Clarification was also made that the Planning and Zoning’s recommendation was on the
building only.
Janet Sloane makes a motion to recommend a Specific Use Permit to David
Umsted to allow a portable building be used as an office for portable building
sales. Agenda item #4. Dale Cavin seconds, motion carries with all ayes.
Discussion: Meeting continued with discussion on the 377 Thoroughfare Plan and
Historic District.
No requirements in current ordinances of what kinds of businesses can go on
commercial property.
Janet shared an interesting and well thought out Powerpoint presentation she is working
on for a future showing to the public of ideas for future growth potential and look of
Tioga. Asked for input from other committee members.
Committee discussed future development of Tioga. What do we want? What do we
want it to look like?
Also discussed our concerns of allowing variance after variance, how it deteriorates our
ordinances and regulations. We have to start adhering to what has already been set as
our guidelines and foundation, changing what no longer works or applies through the
proper channels and in the right way.
We need to establish who we are as a committee and what we stand for, so that we are
not put in a situation where we are making recommendations on things that have
already been decided. In the future as a committee we need to voice concerns and
express our power to disagree with a recommendation if we have questions until
clarifications are made that will allow us to make an informed recommendation.
