Planning and Zoning Committee Meeting Minutes Meeting Held August 28, 2019

 

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, August 28, 2019 at Tioga City Hall, 600 Main Street, Tioga, Texas.

 

Public Hearing

 

Call to Order: Public Hearing was called to order at 7:08 p.m.

 

Declaring a Quorum: A quorum was declared. The committee members present were Arlene Joice, Kristi Staples, and Kim Chimblo. Guests present; Patrick Shin, Craig Jezek, Nick Smith, Terry Hilliard, Jim and Mavis Sauer, Robert Stengele, Tommy and Kelli Hunter

 

Motion: Zoning change for property located at 200 Cutler St, currently zoned residential to commercial C-2 for retail shopping.

 

Public Comment: Patrick Shin representing his parents (Dong Ho Shin property owner) explained that they would like to use the location to build a donut shop with drive thru. They would like to build on the existing sense of community positively. They would like to start building by Spring.

 

Terry Hilliard spoke to the change in the affirmative, said that the property was originally zoned residential in 1985 and kept that way because of taxes.

Declaring a Quorum: A quorum was declared. The committee members present were Arlene Joice, Kristi Staples, and Kim Chimblo. Guests: Terry Hilliard, Jim and Mavis Sauer, Robert Stengele, Tommy and Kelli Hunter, Nick Smith, Patrick Shin and Craig Jezek.

Approval of Minutes: Minutes for June 26, 2019 meeting reviewed and approved. Motion made by Kim Chimblo, second by Kristi Staples; all ayes motion carries. Minutes for July 31, 2019 meeting reviewed and approved. Motion made by Kim Chimblo, second by Kristi Staples; all ayes motion carries.

 

Discuss and Consider

 

Zoning Change for property located at 200 Cutler St. Motion made by Kim Chimblo to change the zoning at 200 Cutler St. from residential to commercial C-2 for retail shopping. Second, Kristi Staples; all ayes, motion carries. Recommendation will be made to the City Council.

 

Creekside Crossing to present Preliminary Plan for approval. Motion made by Kim Chimblo to table Creekside Crossing Preliminary Plan to September meeting due to lack of evidence to support requested changes. Second, Kristi Staples; all ayes, motion carries.

 

Jim and Mavis Sauer to address P&Z concerning Creekside Crossing Development. Present with Jim and Mavis Sauer, Engineer with Eikon, Robert Stengele.  Mr. Stengele presented a comprehensive review of the Sauer’s concerns with the pending Creekside Crossing Development. Jim and Mavis Sauer continue to have many concerns and questions regarding the development. They would like access to any and all public documents and information concerning this matter.

Planning and Zoning Committee Meeting

Minutes Meeting Held July 31, 2019

An impact fee advisory committee and regular meeting of the Planning and Zoning Commission
of the City of Tioga, Texas was held on Wednesday, July 31, 2019 at Tioga City Hall, 600 Main
Street, Tioga, Texas.

Call to Order: The impact fee advisory committee meeting was called to order at 7:00 p.m.

Declaring a Quorum: A quorum was declared. The committee members present were Arlene
Joice, Kim Chimblo, Elliot Townsend and Terry Hilliard. Kristi Staples was not present. Guests
present: Dong Ho Shin and Hyangmi Shin of Little Elm and Mavis Sauer, Tioga property owner.
The committee reviewed the capital improvement plan. Upon review of the impact fees, Terry
Hilliard made a motion to keep the present fees the same. Elliot made the second. The motion
carried. All ayes.

The meeting closed at 7:10.

The regular meeting was called to order at 7:10.

Prayer: Given by Arlene Joice.

Approval of Minutes: This was tabled as they were not available.

Discussed and considered zoning change for property located at 200 Cutler St.
Dong Ho Shin requested a change from Residential to C-2 for retail shopping. Kim made a
motion to change the zoning. Elliot made the second. Motion passed. All ayes.

Next Meeting: Next meeting for a public hearing for Cutler property scheduled for August 28,
2019 at 7:00 pm.

Planning and Zoning Committee Meeting Minutes Meeting Held June 26, 2019


A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, June 26, 2019 at Tioga City Hall, 600 Main Street, Tioga, Texas.

Impact Fee Advisory Committee Meeting

Call to Order: The P&Z Impact Fee Advisory meeting was called to order at 6:36 p.m.

Declaring a Quorum: A quorum was declared. The committee members present were Arlene Joice, Kristi Staples, Elliot Townsend. Kim Chimblo was not present. Guests present; Terry Hilliard and Mavis Sauer.

Motion: Table the Impact Fee Recommendation until July meeting to allow more time to review the numbers and make comparisons. Motion made by Terry Hilliard, 2nd by Elliot Townsend, motion carries all ayes. Meeting to be held July 31, 2019 at 7:00 pm.

Adjourn: Impact Fee Advisory Meeting closed 6:58 pm.

Approval of Minutes: Minutes for the May 29 meeting reviewed, motion to approve made by Elliot Townsend, seconded by Kristi Staples, all ayes
 
Discuss and Consider

In reference to the Planned Development at FM 922 traffic analysis is in the works and won’t be required until the final plat is submitted.
 
Elliot Townsend is in contact with TCOG in reference to a regional master plan and how it will affect Tioga and ways Tioga can be involved to get a plan specific to our needs that is also regionally consistent, to allow continuity.  There is a company that works with smaller cities, like Tioga, on city zoning, annexation, and other city issues. Tioga would be required to pay 50% and TCOG would help supplement the remainder.Once the company has a better idea of a plan they can come and make a comprehensive presentation to the city.  We will keep in touch and continue to look for problem solving options.

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Wednesday, May 29, 2019 at Tioga City Hall, 600 Main Street, Tioga, Texas.
 
Call to Order: The P&Z meeting was called to order at 7:06 p.m.
 
Declaring a Quorum: A quorum was declared. The committee members present were Arlene Joice, Kristi Staples, Elliot Townsend. Kim Chimblo was not present. Guests present; James Sauer and Mavis Sauer.

Prayer: Given by Kristi Staples

Approval of Minutes: Minutes for the March meeting, motion to approve made by Elliot Townsend, seconded by Kristi Staples, all ayes, motion carried. Motion to approve the minutes of May 1, 2019 meeting (Special Hearing and Reg Meeting) made by Elliot Townsend, seconded by Kristi Staples, all ayes, motion carried.

Discuss and Consider

Set schedule for Impact Fee advisory committee meeting, required each year, to be held at time of next scheduled regular meeting on June 26, 2019 at 6:00 p.m. Must have a real estate agent present.

A resolution was presented to the City Council from the Planning and Zoning Committee changing the zoning on a 70.422 acres tract of land located generally at the corner of FM 922 and Texas Street to designate the property as a Planned Development Zoning District and to recommend that a traffic analysis and detention accounting for all storm events to predeveloped conditions be done. To the knowledge of the committee no traffic analysis for the Creekside Crossing a Planned Development has been completed at this time. The committee has received no reports in response to this request.

It was agreed between committee members that more participation and accountability needed to take place between the Planning and Zoning Committee and the City Council.

 There will be a Public Hearing on June 10, 2019 with the City Council.

May 1st Public Hearing and Special Meeting

A regular meeting of the Planning and Zoning Commission of the City of Tioga, Texas was held on Monday, May 1, 2019 at Tioga City Hall, 600 Main Street, Tioga, Texas.


Call to Order: The P&Z meeting was called to order at 7:01 p.m.


Declaring a Quorum: A quorum was declared. The committee members present were Arlene Joice, Kristi Staples, Elliot Townsend, and Kim Chimblo. Guests present; Stuart Baxter, James Sauer, Mavis Sauer, Pam Chapel, Dugan Rainy, Mr. and Mrs. Bridges, and Nick Smith and Steve Moore with Creekside Crossing.


Public Hearing to receive comments on a proposed ordinance amending the city of Tioga Comprehensive zoning ordinance (No. 259) by changing the zoning on a 70.422 acres tract of land located generally at the corner of FM 922 and Texas Street and designating the property as a planned development zoning district.


Comments by long standing resident, James Sauer: Strongly against development at this time. Worried a bigger developer could purchase and expand development quicker than currently planned. Concerned about run-off onto his property, inadequacy of current water lines, and that the quality will be lacking in many ways whether with lot size or development layout if we move too fast.


Stuart Baxter: Against development at this time. Concerned about traffic issues that will be created by the development. Also does not completely understand the commercial zoning and patio homes in the planning and would like to see it down to 150 homes planned instead of 300.
Mavis Sauer: Property owner, has been involved with the land agriculturally for 48 years. Property has long standing renters, Mr. and Mrs. Bridges. Against the development. Concerned that there are inconsistencies with the legal description and the ordinance. Has worries about the amount of concrete that will be added to the landscape and the effects it will have. Also, has serious concerns about the city’s plan to manage a large development when she as one person has had many issues getting city compliance and aide in the past.


Pam Chapel: Tioga resident. Against the development. Is very concerned about the lack of value smaller homes and many homes will bring to the area. Concerned about added traffic and congestion. Against growth at all, but definitely against fast growth.


Dugan Rainey: Tioga resident. Feels that development is good, but is concerned about traffic safety issues and increased flooding issues. Their are some safety concerns that he would like to have clarified and have some certainty about before building begins.


Nick Smith and Steve Moore addressed concerns and issues of those present. They stated that lots will be bigger than those specified in the ordinance as the smallest lot size allowed and that there will be safety at the forefront when considering entrances and exits and traffic safety issues. That road conditions themselves should increase and that the water and sewer lines they are installing could help improve the current lines used by the surrounding land owners. They have consulted with an engineer on all runoff and water drainage issues and do not foresee compounded problems. They offer their availability to answer questions or address concerns. It is their plan and intent to improve Tioga as a city and build a quality product.

Discuss and Consider


Elliot Townsend commented on the commonness of putting a buffer between higher and lower density areas with varied housing plans and that we have also asked many questions with concerns to drainage and traffic.


Townsend offered as a committee we could recommend to the city that a traffic impact analysis be done. As a committee we also agree that the city should make serious considerations with regard to water and sewer issues.


Elliot Townsend makes a motion to approve the Planned Development with a recommendation that a traffic impact analysis be done and detention be designed to account for all storm events to predeveloped conditions. This recommendation comes as support from the committee to address concerns voiced by residents with adjacent and adjoining properties. Kim Chimblo seconds, all ayes, motion carries.


Planned Development is a zoning issue for this meeting, there are many other steps to follow. Our discussion is limited to zoning which pertains to density.
